Hereinafter referred to as “Pentagram of Health”, “we”, “us”, or “our”.
2. Scope of Services
Pentagram of Health provides:

The exact scope of Services is described at the time of purchase or booking.
Services may be delivered digitally, at our physical training location, or in a hybrid format.
3. Eligibility
Our Services are available only to individuals who are 18 years of age or older.
By purchasing or using our Services, you confirm that you are at least 18 years old.
4. Medical Disclaimer and Assumption of Risk
Pentagram of Health provides coaching and nutrition guidance.
The founder is a former Croatian registered dietitian nutritionist. Services are not provided as licensed medical treatment under Dutch healthcare regulations or any other regulated healthcare framework.
All Services are intended for educational, performance, and lifestyle purposes only and do not constitute medical diagnosis, medical treatment, or healthcare services.
Before participating in any physical training (online or in person), you confirm that:
Participation in physical exercise, whether in-person or online, involves inherent risks, including but not limited to:
By participating in our Services, you voluntarily assume all risks.
To the maximum extent permitted by law, Pentagram of Health shall not be liable for injuries, health complications, or damages arising from participation in training or use of our facilities, except in cases of gross negligence or intentional misconduct.
You must immediately stop exercising and inform your trainer if you experience pain, dizziness, discomfort, or any unusual symptoms.
5. Use of Gym Facilities
When attending in-person training or using gym facilities, you agree to:
Pentagram of Health reserves the right to deny access to the gym or terminate training if safety rules are violated.
6. Subscription, Payment and Booking
6.1 Subscription Services
Certain Services are offered via subscription (monthly or fixed-term).
The applicable pricing, billing frequency, and minimum term are displayed at checkout.
6.2 Automatic Renewal
Subscriptions renew automatically unless cancelled before the renewal date.
You authorize recurring payment via your selected payment method.
6.3 Cancellation
Monthly subscriptions may be cancelled at any time via: support@pentagramofhealth.com
Cancellation takes effect at the end of the current billing period.
Fixed-term subscriptions cannot be terminated before the agreed minimum period unless required by mandatory law.
No refunds are provided for unused periods unless legally required.
6.4 In-Person Session Cancellations
In-person personal training sessions must be cancelled at least 24 hours in advance.
Late cancellations or no-shows will result in the session being charged in full.
7. Right of Withdrawal (EU Consumers)
If you are an EU consumer, you have the right to withdraw from a distance contract within 14 days without giving reasons.

Digital Services
By requesting immediate access to digital Services, you acknowledge that:
If partial performance has occurred, proportionate costs may apply.
In-Person Services
If you book in-person services scheduled within the 14-day withdrawal period and request immediate performance, you acknowledge that proportionate costs may apply if you withdraw after performance has begun.
8. Pause of Subscription
Subscriptions may be paused in case of medically certified illness, subject to written documentation.
Pause periods are limited to a maximum of one (1) month per contract period unless otherwise agreed.
9. Intellectual Property
All materials provided by Pentagram of Health, including:
remain the exclusive property of Pentagram of Health.
You receive a limited, non-exclusive, non-transferable license for personal use only.
You may not:
Unauthorized use may result in termination and legal action.
10. Limitation of Liability
Participation in physical training and use of gym facilities is undertaken entirely at your own risk.
Pentagram of Health shall only be liable where damage is the direct result of proven gross negligence or intentional misconduct by Pentagram of Health.
To the extent permitted by law, any liability shall be limited to the amount paid by the client in the three (3) months preceding the event giving rise to the claim.
Pentagram of Health shall not be liable for:
Pre-existing medical conditions
Undisclosed health issues
Client failure to follow instructions
Independent medical events
Illness, viruses, or infections contracted outside our control
Actions taken outside supervised sessions
Nothing in these Terms excludes liability that cannot legally be excluded under Dutch law.
11. Service Availability
We do not guarantee uninterrupted access to digital Services.
Temporary interruptions may occur due to maintenance, technical issues, or circumstances beyond our control.
12. Force Majeure
Pentagram of Health shall not be liable for delays or failure to perform caused by circumstances beyond reasonable control, including:

Pentagram of Health processes personal data in accordance with:
Personal data is processed based on contract performance, legal obligation, legitimate interest, or consent.

Continued use constitutes acceptance.
16. Severability
If any provision is found invalid, the remaining provisions remain in effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and Pentagram of Health.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands.
Consumers may bring claims before the competent court in their place of residence as required by EU consumer law.
Disputes not resolved amicably shall be submitted to the competent Dutch court.
